Congress Ex-SC Judge S Abdul Nazeer: The Congress and other opposition parties have objected to the appointment of former Supreme Court Justice S Abdul Nazeer as the Governor of Andhra Pradesh. Senior Congress leader Rashid Alvi has even said that it is ‘unfortunate’ to give government posts to former judges of the apex court. Due to this people’s faith in Judiciary goes on decreasing.
Rashid Alvi told news agency ANI, “It is unfortunate to give government jobs, government posts to judges. According to a report, the government sends 50 percent of the retired judges of the Supreme Court somewhere, due to which people’s faith in the judiciary goes on decreasing. Rajya Sabha was given to Justice Gogoi. Now you have made Justice Nazir Saab the governor. Many people have been questioning the decision of the Supreme Court on Ramjanmabhoomi-Babri Masjid. After the appointment of Justice Gogoi, the appointment of Justice Nazir as the governor further strengthens the suspicions of those people.
Manickam Tagore and Jairam Ramesh target Modi government
Congress MP Manickam Tagore took a jibe at the alleged Modi-Adani nexus regarding Nazir’s appointment. He tweeted, “Modi works for Adani, there are some people who work for Modi and are now governors. Then who works for the people? Bharat Mata Ki Jai.” Congress leader Jairam Ramesh has targeted the Modi government by sharing a short video clip of late former Union Minister Arun Jaitley on Twitter.

S Abdul Nazir was involved in the Ayodhya verdict
In fact, in 2019, a five-member constitution bench of the Supreme Court had given its verdict in the Ayodhya case. The five-member constitution bench headed by the then CJI Ranjan Gogoi included Justice S Abdul Nazeer, Justice SA Bobde, Justice DY Chandrachud (currently CJI) and Justice Ashok Bhushan.

BJP leader BL Santhosh has termed the alleged protest against the appointment of Abdul Nazir as the Governor a product of the Congress-Left eco system and said that it has become a practice these days. When the opposition is opposing the appointment of S. Abdul Nazir as the governor, then let us know whether the constitution also considers it wrong?
What does the constitution say about the qualification to become the governor?
Article 157 of the Constitution mentions the qualifications for becoming Governor and Article 158 mentions the conditions for the post of Governor. According to some of these main points, a person who is a citizen of India and has completed 35 years of age can become a governor. He should not be a member of either House of the Parliament or of any House of the Legislature of any State. On becoming the Governor, he will not hold any office of profit.
Is it right for S Abdul Nazeer to be the governor as per the constitution?
As per the constitution, S Abdul Nazeer qualifies to be the governor as he is a citizen of India and is above 35 years of age. He is not a member of either House of Parliament or the Legislature of any State. He has not been in the post of profit before and will not be in the future as per the conditions of becoming the Governor.
Let us tell you that even before this, former judges of the Supreme Court have been appointed as governors. In 1997, former Justice Fathima Beevi was made the Governor of Tamil Nadu and in 2014, former Chief Justice P Sathasivam was appointed as the Governor of Kerala.
