Right To Die: The Supreme Court has given relief to those who wish to die. In the case of passive euthanasia, guidelines have been changed to make them more practical. The Supreme Court has removed the condition of the process of making the Living Will in front of the Magistrate. Apart from this, the court has simplified the conditions for euthanasia.
In the year 2018, the conditions of the order given on the Advance Medical Directive Will have also been simplified. While making changes in this, the court has given more importance to the role of doctors. The court says that the doctors informed about the difficulties faced in this case and it was necessary that the court should look at the guidelines again and make changes.
What in the decision of the Supreme Court in the year 2018?
On March 9, 2018, the Supreme Court gave an important decision in the euthanasia case and said that the right to die with dignity is a fundamental right. Conditional permission was given to adopt death by removing the life support system of those who reach the state of coma or death. The court had recognized Passive Euthanasia i.e. indirect euthanasia and Advance Directive i.e. Living Will and had set guidelines for this.
On this, the Indian Council for Critical Care Medicine had demanded a change in the guidelines and said that the current system is not practical and it is not working. The matter again came before the five judges of the Supreme Court for the change of the guidelines issued in the judgment of the year 2018.
Active euthanasia is a case where doctors intentionally perform an action that causes the death of a critically ill patient. One of the procedures involves giving a lethal chemical compound to end the life of the patient.
