SC Judgment For An Unborn Child: A decision of the Supreme Court is being discussed a lot. To save the life of an unborn child, the Chief Justice of the country discussed with the senior judges of the Supreme Court for about 40 minutes in his chamber and after that he gave a decision to give birth to the child safely. The court ruled for the safe delivery of the unborn child and to provide him a new family.

Actually, the 20-year-old girl had sought permission to abort the unwanted pregnancy. The girl had told the court that she came to know about pregnancy after 7 months. The court was also told that the girl is unmarried and her family is not ready to adopt the child. When the Supreme Court sought advice from AIIMS (AIIMS) on this matter, the doctors of AIIMS advised not to have an abortion. AIIMS doctors say that the period of pregnancy has crossed 29 weeks, so abortion is not justified.

Child will get new family after birth

At the same time, even the family members of the woman are not aware of this, hence confidentiality is being maintained in the meeting. However, it was decided in such a way that it would be in the interest of the unborn child. A three-member bench headed by Chief Justice DY Chandrachud directed AIIMS to ensure the safe delivery of the girl child. Due to the intervention of the Supreme Court, the child will also get a new family after birth. The court has allowed the child to be handed over to a willing family after birth. This family had expressed their desire to adopt the child after knowing about the girl’s petition.

The court gave its verdict under Article 142

Please tell that AIIMS advised in its report that if surgery is done in this situation, the child will come out alive from the womb. After this, the Supreme Court, using the right given under Article 142 of the Constitution, directed AIIMS to deliver and allowed the child to be handed over to the willing family. The bench headed by the Chief Justice also admitted that this case is not like those cases of abortion in which permission has been given.
