Delhi High Court News: The Delhi High Court has ordered the director of a domestic firm Triveni Interchem Pvt Ltd to pay Rs 2 crore to Pfizer. The director of Triveni Intercom is accused of deliberately disobeying court orders. The court directed the company to stop selling the palbociclib compound, whose patent is with Pfizer.
Triveni Interchem Pvt Ltd continued to sell it even after the court’s order. In view of this, Justice C Hari Shankar, in an order dated January 24, 2023, said that the company’s director Kamlesh Singh would have to spend two weeks in Tihar Jail for non-payment. The court has asked Kamlesh Singh to pay Rs 2 crore to Pfizer within two weeks.
What does Pfizer have to say?
According to Pfizer’s lawyer Praveen Anand, Triveni Interchem Pvt Ltd was found to be advertising Palbociclab in Active Pharmaceutical Ingredient (API) form on its websites and IndiaMart (e-commerce platform) without any permission. In October 2021, the High Court gave interim relief to Pfizer and directed Triveni to remove all listings from various places.
Pfizer had filed a contempt petition
Even after this, the company continued to sell palbociclib. In view of this, Pfizer once again filed a contempt petition against the company in the High Court. On July 7, 2022, the High Court found that the Triveni institutions were in contempt of the order. After this, the company was asked to present its reply in the matter. After this, the Triveni institutions filed an affidavit with an unconditional apology. However, it lacked material information and was not accepted by the court order.
