Supreme Court Collegium News: The Supreme Court Collegium has recommended the appointment of Chief Justice of Allahabad High Court Rajesh Bindal and Chief Justice of Gujarat High Court Arvind Kumar as judges of the Supreme Court. The resolution of the Collegium, published on the website of the Supreme Court, states that after carefully evaluating the ability, integrity and competence of eligible Chief Justices and senior Judges of High Courts, and after adjusting for plurality of views, the Collegium may nominate the following persons as Chief Justices of India: finds him more qualified and suitable in all respects for appointment as a Judge of the Supreme Court
The Collegium is headed by Chief Justice DY Chandrachud and comprises Justices Sanjay Kishan Kaul, KM Joseph, MR Shah, Ajay Rastogi and Sanjiv Khanna. It further said that the Collegium deliberated and discussed the names of Chief Justices and Senior Judges of High Courts eligible for appointment to the Supreme Court. The resolution said that the judgments written by the people coming under consideration for elevation to the Supreme Court were circulated among the members of the Collegium for meaningful discussion and evaluation on their judicial skills.
Collegium recommended five names
On December 13, 2022, the collegium recommended five names for appointment as judges of the Supreme Court, including Justice Pankaj Mithal, Justice Sanjay Karol, Justice P.V. Sanjay Kumar, Judge Ahsanuddin Amanullah, and Judge Manoj Mishra. His appointment has not yet been notified by the government. The Supreme Court has a sanctioned strength of 34 judges and is currently working with 27 judges. Thus, there are seven vacancies. Detailing the reasons for the selection of the two Chief Justices for elevation to the Supreme Court, the collegium said the following aspects have been considered while recommending the two names.

There is a need to ensure diversity and inclusion in the Supreme Court by (1) representation of High Courts that are not represented or inadequately represented in the Supreme Court (2) appointing persons from marginalized and backward sections of society (3) gender diversity and (4) ) Representation of Minorities. The Collegium resolves to recommend that (1) Justice Rajesh Bindal and (2) Justice Arvind Kumar be appointed as Judges of the Supreme Court.
There will be preference on two names for appointment to the Supreme Court
The collegium said that by its resolution dated December 13, 2022, the names previously recommended by the collegium will have precedence over the two names currently recommended for appointment to the Supreme Court. The Collegium said that the resolution of the Collegium regarding the appointment of Chief Justice of Allahabad High Court, Rajesh Bindal, is unanimous. However, with regard to the appointment of Chief Justice of Gujarat High Court Arvind Kumar, Justice KM Joseph has expressed his reservations on the grounds that his name may be considered later.
Justice Bindal was appointed as a judge of the Punjab and Haryana High Court on March 22, 2006. He was appointed as the Chief Justice of the Allahabad High Court on October 11, 2021, and is at serial number 2 in the combined all-India seniority of High Court judges and is the senior-most judge of the Punjab and Haryana High Court. Justice Arvind Kumar was appointed as an additional judge of the Karnataka High Court on June 26, 2009 and as a permanent judge on December 7, 2012. He was elevated as the Chief Justice of the Gujarat High Court on October 13, 2021.
Judge Arvind Kumar is at serial number 26 in the combined all-India seniority of High Court judges. While recommending his name, the Collegium is cognizant of the fact that in the seniority of Judges coming from the Karnataka High Court, Justice Arvind Kumar is at Sl No. 02 and at present, the Supreme Court Bench is represented by two Judges of the Karnataka High Court.
